RS1 TC, LLC (‘ThirdChannel’ or ‘we’ or ‘us’ or ‘our’) collects and processes your personal information in accordance with this Privacy Policy (‘Policy').

This Privacy Policy describes rights that you may have and our obligations, and explains how, why and when we process your personal information when you:

  • visit, interact with or use any of our websites (including www.thirdchannel.com and applicable sub-domains) and mobile apps that link to this Policy, or integrations with third-party services, social media pages, online advertisements, marketing, sales communications, or other interactions with us;
  • visit, interact with or use any of our offices, events, sales, marketing, and other offline activities;
  • submit a job application to ThirdChannel; and/or
  • purchase or use any ThirdChannel products and services as an authorized end user (for example, as an individual customer or as an authorized team member of one of our business customers), when we act as a data controller of your personal information.

When we refer to any combination of the above, we use the term ‘Services’. ‘You’ means you as the user of the Services, whether you are a visitor to our websites, offices or social media pages; a recipient of our communications or online advertisements; a job applicant; a user of our Services; or another individual whose information we have collected pursuant to this Policy.

When you access or use our Services, you acknowledge that you have read this Policy and understand its contents. Your use of our Services and any dispute over privacy is subject to this Policy and any applicable service terms (including any applicable limitations on damages and the resolution of disputes).

ThirdChannel invites you to leverage our website, iOS, and Android applications in pursuit of growing the customers we support. Throughout this privacy policy, any reference to our application, encompasses our external sales website, internal web application, iOS application, and Android application. It is important to carefully read our privacy policy governing the use of this application. If you do not agree with these terms and conditions, please do not use our site or mobile applications.

Collecting and using your personal information at ThirdChannel

We are committed to protecting the privacy of all visitors and users. In order to fully understand your rights, please read this privacy statement before using the ThirdChannel website or our ThirdChannel App.

ThirdChannel gathers information from visitors in multiple ways:

  • Registration

  • Participation in the services available

Registration

When you register at the site, we collect information, which allows us to identify you. The more information you provide, the better we are able to customize our services and your experience to suit your needs and preferences.

Cookie Technology

Cookies are small pieces of data that are stored on your computer, mobile phone, or other devices. ThirdChannel uses cookies solely for the purpose of facilitating the user experience on our site, like allowing pages to load faster because certain content is stored on your browser, or by helping us authenticate you to deliver personalized content. A cookie is a message that is sent to your browser from a web server and stored on your computer’s hard drive. Most Internet sites use cookies.

You can set your browser preferences to reject all cookies but then you will not be able to participate in most customized services and you may be required to repeatedly type in certain information. Cookies make your experience easier by saving preferences and passwords. We also use cookies that contain no personal information at all. These cookies help us estimate our web traffic, determine which areas of the site are the most popular, and deliver relevant messages.

IP Address

We may also log IP addresses for the purpose of systems administration or to report information in aggregate form to third parties (e.g., how many visitors logged in to our site). An IP address is a number that is assigned to your computer automatically when you use the internet. When you visit a particular web page on ThirdChannel our servers log your IP address. We do not link your IP address to anything personally identifiable.

Your communication with us

Contact us by site chat: If you communicate with us via our chat feature on our site, you consent that we may monitor or record those interactions. This is done for reasons such as maintaining the integrity of your account, providing effective and timely service, and the improvement of our platform.

Disclosure of personal data

ThirdChannel may disclose your personal data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of ThirdChannel, (iii) act in certain circumstances to protect the personal safety of users of the site or the public, or (iv) protect against legal liability.

How is personally identifiable information used?

We will ask you when we need information that personally identifies you (personal information) or allows us to contact you.

To create a customized look and feel, ThirdChannel gathers information to provide you with an effortless experience. For instance, your personal information enables us to greet you when you return to ThirdChannel and to provide you with your specified preferences (e.g., site look and feel and preferred categories and content).

If you register with ThirdChannel, from time to time, we may email you informative messages about the services or educational resources we believe may be of interest to you.

  • To facilitate communication between retail partners and the representatives servicing locations
  • To notify users of news or events that pertain to their role in the organization or requested information
  • To invite users to join relevant teams based on interests
  • To track the demographics of our users
  • To pay users for their work products

Does ThirdChannel share information?

We will not disclose your personal information to third-parties except to the extent necessary to provide you with a requested service, or under circumstances required by law. In addition, we will comply with the request for your personal information from any law enforcement or regulatory agency or when any applicable law, regulation, or legal process requires it. 

We also may disclose aggregated data derived from the information you and other visitors provide. Please keep in mind that aggregate data is not traceable to you specifically. Please note, however, that we do not control the privacy policies of third-party sites to which we provide links. If you click through a link on www.thirdchannel.com and submit your information to another entity, you will be subject to their own privacy policies. We assume no responsibility or liability for these third-party privacy policies.

Control the use of personal information

Most browsers can be configured to reject cookies or alert you when cookies are being sent. You may cancel your registration with ThirdChannel and/or request the removal of your personal information from our visitor records by sending an email to support@thirdchannel.com. We will send an email to confirm your request. After you respond, we will remove your information from our database. Residual information may remain in our archives and records, but this information will not be used for commercial purposes. We reserve the right to maintain information on registered visitors who have violated any of our policies or who have had their access to ThirdChannel blocked. For users that have been paid by ThirdChannel, personal information tied to normal tax proceedings will be maintained in order to comply with tax obligations.

What else should I know about my privacy?

You should be aware that if you voluntarily disclose personal information online in a public area, that information might be viewed and used by others. Please remember that you are solely responsible for maintaining the secrecy of any password you use on the site.

Your rights with regard to the data we collect

As a Data Subject in the European Economic Area, you have the right to request, access, rectify, erase, and restrict how we process your personal data. These rights include the ability to review the personal data we have in our Information and Communications systems concerning you, the ability to make any corrections to that personal data, the ability to be informed of who that data may have been shared with, the ability to request that we erase all of your personal data, and the ability to restrict how we process your personal data.

We are required to respond to any of your requests to exercise these above Data Subject rights within 30 days. Should we be unable to comply within 30 days, we will contact you and let you know of any delay.

Location services

When checking into locations, the ThirdChannel mobile applications require location services to be enabled. We capture only enough information to validate visits and assist users traveling to the correct locations. In order to avoid capturing the travel patterns of our users we employ geofencing technology. For the duration of a visit, ThirdChannel collects inside and outside events tied to the visit location. In addition, to visit validation, ThirdChannel uses foreground location services to help with scheduling jobs. Location data is never shared outside of the ThirdChannel organization.

Disclosure of personal data

ThirdChannel may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of ThirdChannel, (iii) act in certain circumstances to protect the personal safety of users of the Site or the public, or (iv) protect against legal liability.

Security of your personal information

ThirdChannel strictly protects the security of your personal information and honors your choices for its intended use. We carefully protect your data via various forms of encryption from loss, misuse, unauthorized access or disclosure, alteration, or destruction.

Agents, consultants, and related third-parties

Like many businesses, ThirdChannel sometimes hires other companies to perform certain business-related functions. Examples of such functions include mailing information, maintaining databases, and processing payments. When we employ another company to perform a function of this nature, we only provide them with the information they need to perform their specific function. They are prohibited from using the information for any other purpose.

California Privacy Rights

California law permits residents of California to request certain details about what personal information a company shares with third-parties for the third-parties direct marketing purposes. ThirdChannel will not share your information with third-parties for the third-parties own and independent direct marketing purposes without your permission.
